PRESS RELEASE – PORN STAR LISA ANN’S HARASSMENT CASE AGAINST NIKKI BENZ THROWN OUT OF COURT

The Los Angeles Superior Court ruled in favor of Nikki Benz (@NikkiBenz) and threw out of Court porn star Lisa Ann’s (@theRealLisaAnn) harassment case (case Number BS152586), after granting Ms. Benz’ Anti-Slapp motion.  Lisa Ann filed a harassment case after a well publicized twitter feud. The court filing regarding the Lisa Ann/Nikki Benz ‘twitter war’ picked up coverage at TMZ (http://bit.ly/19fmBRr) and other media outlets around the world (http://bitly.com/19fmBRt).

Benz’ ”Anti-Slapp” Motion against Lisa Ann – seeking a ruling that Lisa Ann’s case was frivolous and ‘not supported by the evidence’, was granted in its entirety after a hearing Monday.  Lisa Ann is best known for her portrayal of Sarah Palin in the ‘Nailin’ Palin’ series.  She retired from adult last year.  Nikki Benz is a Penthouse Pet of the Year winner and recently made world headlines after it was suggested she run for Mayor of Toronto.

Credit: (Mandatory): Rachel Worth / WENNRuling in Nikki Benz’s favor The Los Angeles Superior Court agreed nothing Nikki Benz tweeted or said about Lisa Ann at the XBIZ Awards in January 2015 amounted to an actionable claim for harassment.  As stated ”[Lisa Ann] has failed to submit sufficient evidence to demonstrate her petition has the minimal merit”.

A copy of the ruling, adopted in it’s entirety by the court after a hearing is attached.  Benz is represented by Beverly Hills attorney, Stephen M. Kernan.

Nikki Benz states: “I am thrilled that the Court has thrown out Lisa Ann’s frivolous case for supposed harassment against me. I intend to pursue her for all damages she has caused me as a result. Filing legal cases just to get in TMZ is just sad.  A big thank you to all adult stars and industry people who showed me support on twitter and in court.  The overwhelming support is greatly appreciated.”

Stephen Kernan, Esq. adds: “This case involved interesting issues of first amendment, publicity and social media.  Courts would be overflowing with even more cases if they allowed ‘harassment’ cases to proceed every time a twitter war breaks out.  True harassment cases must be supported with evidence, not manufactured theories that make great soundbites on TMZ. We are glad the Court ruled in Nikki Benz’ favor.  The statute now requires Murphy pay Ms. Benz’s attorney’s fees incurred in this matter, and we intend to file a motion for those fees shortly.”
